Oviparous organisms are those in which fertilization is internal/external and male insert sperms through intromittent organ.

When internal fertilization fails to happen , eggs are laid unfertilized because egg laying is a part of ovulation which occurs irrespective of fertilization. In this , eggs never get fertilized after they shed off i.e. it has to be internal.

Therefore oviparous organisms either lay eggs with embryo (fertilized) or merely eggs (unfertilized).
